Legalisation of Assisted Suicide in the Czech Legal Order

Abstract:

Tato diplomová práce se zabývá nalezením klíčových předpokladů pro legalizaci asistované sebevraždy v České republice. Problematika asistované sebevraždy není zdaleka jen právním a filozofickým tématem, ale zasahuje také do oblasti zdravotnictví a etiky. V práci se tedy snažím zohlednit co nejvíce relevantních aspektů, jež do tohoto tématu zasahují. Nejprve v práci definuji důležité pojmy – asistovanou sebevraždu, eutanázii a paliativní péči. Dále se zabývám aktuálním stavem zdravotnictví v kontextu otázky konce života. Rozebírám také několik etických dilemat, které vyvstávají jak ze strany odpůrců, tak i příznivců legalizace. Dále uvádím pohled české legislativy na asistovanou sebevraždu a poté se věnuji dosavadním iniciativám její legalizace v podobě návrhů zákonů. V poslední části uvádím téma asistované sebevraždy a její regulace do kontextu základních lidských práv, a to především z pohledu soudní praxe Evropského soudu pro lidská práva.

Abstract:

This thesis deals with the identification of key prerequisites for the legalization of assisted suicide in the Czech Republic. The issue of assisted suicide is far from being just a legal and philosophical topic, but it also affects the field of health care and ethics. Therefore, in this thesis I try to take into account as many relevant aspects that interfere with this topic as possible. Firstly, I define the important terms in this thesis - assisted suicide, euthanasia and palliative care. Furthermore, I discuss the current state of healthcare in the context of end-of-life issues. I also address several ethical dilemmas raised by both opponents and supporters of legalization. Next, I present the view of the Czech legislation on assisted suicide and then I discuss the initiatives taken so far to legalize it in the form of draft laws. In the last part I introduce the topic of assisted suicide and its regulation in the context of fundamental human rights, especially from the perspective of the case law of the European Court of Human Rights.
