Social services and their legal regulations in Czech law

Abstract:

Sociální služby představují jednu ze základních součástí sociálního zabezpečení v České republice. Jsou zpravidla řazeny do pilíře sociální péče a od jiných druhů sociálního zabezpečení se liší povahou svého plnění, které není, resp. nemusí být primárně peněžité ale věcné. Osobám, kterým zpravidla v důsledku zdravotního handicapu, hrozí sociální vyloučení, má být poskytnuta konkrétní služba, díky níž bude mít uvedená osoba možnost se zapojit do společnosti. Důsledky uvedeného handicapu budou v důsledku toho ne sice zcela překonány, ale alespoň bude zmenšen jejich negativní dopad. V současné době je poskytování sociálních služeb v České republice upraveno zákonem č. 108/2006 Sb. o sociálních službách. Ten upravuje podmínky nároku na příspěvek na péči jako peněžitou dávku, za níž se předpokládá, že si handicapovaný bude moci „nakoupit“ příslušnou sociální službu. Upravuje však i konkrétní podmínky pro fungování poskytovatelů sociálních služeb. Práce by se měla zaměřit zejména na situaci v rodinách s handicapovanými dětmi a v rodinách pečujících o seniory. Péče o handicapované děti a stejně tak i o seniory, pokud již vzhledem k věku nejsou schopni plně si obstarat své záležitosti, může představovat pro příslušnou rodinu určitou zátěž přinejmenším v podobě času, který musí této péči věnovat. Vždy je tedy výhodou, pokud mohou využít i pomoc specializovaných poskytovatelů sociálních služeb. Zákon proto počítá s existencí takovýchto poskytovatelů. Cílem práce je provedení analýzy platné právní úpravy sociálních služeb, specifických potřeb rodin s handicapovanými dětmi a rodin pečujících o seniory a analýza systému poskytovatelů sociálních služeb v Ústeckém kraji z hlediska jejich schopnosti poskytovat sociální služby potřebného zaměření v dostačující kvalitě a množství.

Abstract:

Social services are one of the basic components of social security in the Czech Republic. They are usually classified into a pillar of social care and differ from other types of social security by the nature of their performance, which is not, may not be primarily monetary but material. Persons who, as a rule, suffer social exclusion as a result of a health handicap, should be provided with a specific service that will allow the person to join the company. As a result, the consequences of this disability will not be overcome, but at least their negative impact will be diminished. At present, the provision of social services in the Czech Republic is regulated by Act No. 108/2006 Coll. on social services. It governs the eligibility conditions for a care allowance as a cash benefit, which is supposed to be able to "buy" the relevant social service. It also regulates the conditions for the operation of social service providers. The work should focus especially on the situation of families with handicapped children and families caring for the elderly. Taking care of disabled children as well as the elderly, if they are unable to fully manage their affairs due to their age, may represent a burden for the family concerned at least in the form of time to care for that care. It is therefore always an advantage if they can also benefit from the help of specialized social service providers. The law therefore provides for the existence of such providers. The aim of the thesis is to analyze the legal regulation of social services, the specific needs of families with handicapped children and senior care families, and to analyze the system of social service providers in the Ústecký Region in terms of their ability to provide social services in the necessary quality and quantity.
