Use of mediation in the field of social and legal protection of children

Abstract:

Bakalářská práce seznamuje s mediací jako alternativním způsobem řešení konfliktů hlavně v oblasti rodinných sporů, kde je velký důraz kladen na zájem nezletilého dítěte. V teoretické části práce je vysvětlen pojem mediace, typy vhodných a nevhodných sporů pro mediaci, role mediátora v procesu mediace, Zákon o probační mediační a službě v trestní justici. Je zde popsán Zákon o sociálně právní ochraně dětí a náplň sociálních pracovníků na odboru sociálně právní ochrany dětí. V práci je uvedena instituce, která se zabývá rodinnými a občanskoprávními spory a jaký je současný stav mediace v ČR. V praktické části jsou popsány případové studie a průběh rozhovoru s klienty, sociálními pracovníky a mediátory, které vedou k naplnění cílů práce.

Abstract:

The bachelor paper introduces the mediation as an alternative way of solving the problems mainly in the area of family conflicts, where is a great emphasis put on the interest of the minor child. In the theoretical part is explained the term mediation, types of suitable and unsuitable causes for mediation, the role of the mediator in the process of the mediation, The Act on Probation and Mediation Service in criminal law. The Act on Socio-legal Protection of Children is described and also the scope of employment of social workers at child protection department. The institution for the solution of the family and civil law conflicts is presented. The current situation of the mediation in the Czech Republic is described. In practical part are presented case studies worked up on the interviews with the clients, social workers and mediators and they are leading to the fulfillment of the aims of the work.
