Abstract:

Cílem mé práce bylo objasnění problematiky opatření obecné povahy a to ve vztahu k otázkám, co je možné považovat za opatření obecné povahy, jaké jsou jeho hlavní znaky, za jakých podmínek lze tento institut v rámci veřejné správy využít. Práce je však především zaměřena na objasnění možností ochrany jednotlivců, kteří se cítí být na svých právech konkrétním vydaným opatřením obecné povahy dotčeni u správního soudu. První část práce, která je věnována rešerši a analýze judikatury Nejvyššího správního soudu a Ústavního soudu týkající se institutu opatření obecné povahy. Je zde řešena otázka, co lze za opatření obecné povahy dle judikatury považovat, jakým stylem probíhá argumentace soudů v případě pochybností, zda se opravdu jedná o tento institut, či jestli jsou upřednostňovány znaky formální nebo materiální, případně jejich kombinace. Z rešerše judikatury je patrné, že soudy při posouzení opatření obecné povahy spíše preferují materiální hledisko před hlediskem formálním. Základem argumentace je vždy posouzení materiálních znaků, a to konkrétně určeného předmětu a obecně vymezeného počtu adresátů, a to i v případě, že je posuzovaný akt ve speciálním zákoně označen jako opatření obecné povahy, absence materiálních znaků totiž vždy vede ke zrušení opatření obecné povahy. Naopak je možné, že pokud formálně neoznačený akt splňuje materiální hlediska, je označen jako opatření obecné povahy. V této části je pojednáno o procesních předpisech vztahujících se k vydávání opatření obecné povahy a možnostech jeho přezkumu v správním řízení. Následuje popis řízení o opatření obecné povahy před správními soudy po novele soudního řádu správního. V druhé části práce jsou popsány jednotlivé typy opatření obecné povahy z hlediska jejich úpravy v zvláštních zákonech a výsledky judikatorní činnosti soudů vztahujících se k již vydaným opatřením obecné povahy správními orgány. Význam problematiky přezkumu opatření obecné povahy se bude v důsledků stále častějšího výskytu tohoto institutu ve zvláštních zákonech zvyšovat a předpokládá se nárůst návrhů na přezkum opatření obecné povahy v správním soudnictví i z toho důvodu, že z přechodných ustanovení stavebního zákona vyplývá, že v průběhu nejbližších let prakticky všechny územní plány všech obcí budou muset být vydány dle nové procedury jako opatření obecné povahy. Domnívám se, že se u opatření obecné povahy může jednat o významný zásah do práv jednotlivců, a podle mého názoru k ochraně práv dotčených osob, kteří v soudním řízení správním mohou vystupovat jako navrhovatelé nebo jako osoby na řízení zúčastněné novela soudního řádu správního významnou měrou přispěla.

Abstract:

The aim of my work was to clarify the problematic area of general administrative measures in the relation to the questions of the characteristics and the conditions of using this instrument in the practice. My work is mainly aimed to clarify the possibility of protecting individuals who feel their rights to be issued by a particular measure of general concern to the Administrative Court. First part of my work deals with background research and analysis of the judicature of the Supreme Administration Court and Constitutional Court. Question which I try to solve if what can we consider as the general administrative measure according to the judicature, what arguments are used by the court when there are doubts about it, whether it is really this institute, whether they prefer formal or material characteristics of their combination. ln the judicature background research we can find that the mentioned courts prefer material point of view more than the form. The base of the argumentation is to judge the material characteristics concretely the object, the subjects also in the case when the judged act is the special law named ad general administrative measures. The absence of the material characteristics leads to the abolition of the act. On the other side it is possible that when the act is formally named differently but it has the material characteristics it is considered as the general administrative measures. This section discusses the procedural rules relating to the issuance of general measures and options to review in the administrative proceedings. The following describes the procedure for general measures before the administrative courts by amendment of the Administrative Procedure Code. In the second part of my work deals with different types of general measures in terms of their treatment in special laws and the courts jurisprudence results related to the already issued a general measure administrations. The importance of the issue of review of measures of a general nature will be the consequences still more frequent occurrence of this institute in special laws to increase and is expected to increase for a review in a general measure of administrative justice also because of the transitional provisions of the Building Act that over the next few years virtually all development plans of all municipalities will have to be issued under the new procedures as a general measure. I think that is the measure of a general nature may be a significant interference with the rights of individuals, and in my opinion, to protect the rights of individuals who, in administrative proceedings may appear as applicants or as persons involved in the management of the Administrative Procedure novel contributed significantly.
