Electronic Communication with the Tax Administrator

Abstract:

Předkládaná diplomová práce se zabývá možnostmi komunikace se správcem daně, se zaměřením na povinnosti daňových subjektů a novinky související s elektronizací veřejné správy. Největší přínos této práce vidím v uceleném shrnutí teoretických poznatků týkajících se elektronické komunikace s orgány veřejné správy. Cílem obecné části je zmapování komplexní právní regulace této komunikace a představení základních institutů pro její uskutečňování. Zvláštní část se zaměřuje na vybrané problémy spojené s datový schránkami a elektronickými podpisy, popisuje odesílání příslušných dokumentů do datových schránek správců daně s ohledem na jejich finanční náročnost, stejně jako výhody a nevýhody tohoto způsobu komunikace. Pro širší kontext je představen nově zavedený institut kontrolního hlášení. Poslední část se zabývá elektronickou evidencí tržeb, a její komparací se systémem fungujícím v Chorvatsku od roku 2013, který byl inspirací pro české zákonodárce.

Abstract:

The diploma thesis deals with the possibilities of electronic communication with the tax administrator. The biggest contribution of this thesis is a comprehensive summary of the theoretical aspect of this communication and its subsequent analysis. The leading part is focusing on the duties for tax payers and new institutes connected with the electronization of public sector. The main aim of the paper is to conduct a comprehensive analysis of methods of the communication with the tax administer and presents the most important institutes like data boxes or tax information box. Other part of the thesis informs about some special problems of data boxes and electronic signatures. The last part of the thesis is explaining new institutes in electronic communication - vat inspection report and electronic income evidence.
