Criminal law and criminological aspects of the investigation of the crime of murder

Abstract:

Tato bakalářská práce řeší procesněprávní a kriminalistické postupy orgánu činných v trestním řízení, především pak práci kriminalistů v trestním řízení při odhalování a vyšetřování trestného činu vraždy. První část práce se zaměřuje na základní pojmy, mezi něž patří především vlastní pojem vraždy dle trestního zákoníku. Druhá část práce je zaměřena na kriminalistické aspekty související s odhalováním a vyšetřováním trestného činu vraždy, jako jsou způsoby jejího páchání a metodiku vyšetřování vražd. Stěžejní část práce pak podrobně analyzuje procesněprávní postup při odhalování a vyšetřování vražd. V této části jsou spojeny kriminalistické a procesněprávní aspekty a zároveň jsou demonstrovány konkrétní případy použití těchto postupů. K řešení byla použita metoda rešerše literatury, právních předpisů a judikatury, v praktické části pak případová studie, v níž je na reálném případu zhodnocen postup policejního orgánu při vyšetřování vraždy a zároveň obsahuje návrhy de lege ferenda.

Abstract:

This bachelor's thesis pursues with procedural legal and criminological procedures of the law enforcement authorities, especially the work of criminologists in criminal proceedings in the detection and investigation of the crime of murder. The first part of the work focuses on basic terms, which include the actual term of murder according to the Criminal Code. The second part of the work is focused on criminological aspects related to the detection and investigation of the crime of murder, such as the methods of committing it and the methodology of the investigation of murders. The main part of the work analyzes in detail the procedural legal procedure in the detection and investigation of murders. In this part, criminological and procedural legal aspects are combined, and at the same time concrete cases of the use of these procedures are demonstrated. The method of researching literature, legal regulations and jurisprudence research was used for the solution, and in the practical part, a case study in which the procedure of the police authority is evaluated on a real case in the investigation of the murder and at the same time contains proposals de lege ferenda.
