Competition Law Limitations of Intelectual Property Rights

Abstract:

Práce se zabývá studiem vztahu práva duševního vlastnictví a práva hospodářské soutěže v českém a evropském právu s přesahy do právních řádů dalších zemí. V úvodní části představuje základní koncepty obou odvětví. Jádro práce je věnováno studiu vztahu jednotlivých ochranných institutů práva duševního vlastnictví a soutěžní regulace, ukazuje podstatu a důsledky střetu regulace obou odvětví. V závěru popisuje společné jmenovatele situací, kdy mezi oběma odvětvími nastává konflikt i situací, kdy tento konflikt nevzniká.

Abstract:

The thesis deals with the relationship of intellectual property law and competition law in Czech and European law with overlaps to other jurisdictions. The first part describes the basic concepts of both fields of law. The core of the thesis is dedicated to the study of the relationship of the individual institutes of IP law and competition regulation, presents the foundations and implications of their conflict. The final part of the thesis describes common elements present in situations of conflict and coexistence of both fields of law.
