Protection of Personal Data in the Czech Republic and Finland

Abstract:

Diplomová práce se zabývá srovnáním právní úpravy ochrany osobních údajů ve Finsku a České republice. Přestože historický, politický a právní vývoj byl v obou zemích rozdílný, Finsko a Česká republika jsou nyní členskými státy Evropské unie, což ovšem ani přes implementaci směrnice č. 95/46/ES, o ochraně fyzických osob v souvislosti se zpracováním osobních údajů a o volném pohybu těchto údajů, neznamená, že právní úpravy ochrany osobních údajů jsou v těchto zemích zcela totožné. Úvodní část práce stručně představuje mezinárodní a unijní východiska ochrany osobních údajů a dále se pak diplomová práce zaobírá ústavněprávním rámcem ochrany osobních údajů v České republice a ve Finsku, stejně jako vymezením pojmu osobního údaje. Hlavní část práce se soustřeďuje na srovnání obecné právní úpravy ochrany osobních údajů představované zákonem č. 101/2000 Sb., o ochraně osobních údajů a změně některých zákonů, a zákonem č. 523/1999, o osobních údajích, především v oblasti jejich působnosti, práv a povinností týkajících se ochrany osobních údajů a jejich zpracování, úřadů pro ochranu osobních údajů a trestání. Nakonec jsou uvedeny vybrané problémy v praxi ve Finsku.

Abstract:

This thesis studies personal data protection policies in two countries: the Czech Republic and Finland. Despite the fact that these states have undergone different historical, political and legal development, nowadays they are both the members of the European Union, membership of which guarantees that legal regulations of personal data protection are consistent throughout the Union. The implementation of the European Union Directive 95/46/EC on the protection of individuals with regard to the processing of personal data and on the free movement of such data does not translate in the Czech and Finnish legal regulation being the same, though. The introductory part of the thesis briefly discusses the international and the European Union legal basis for the personal data protection and the European Union legislation. The thesis also analyzes the constitutional framework of the personal data protection in the Czech Republic and Finland as well. Next the thesis explains the definition of personal data. The core part of the thesis is concerned with comparison of general legal regulation of personal data protection, i. e. the Czech Act no. 101/2000 Coll., on the Protection of Personal Data and on Amendment to Some Acts, and the Finnish Act no. 523/1999, Personal Data Act. The general personal data acts are described and compared in five main levels: the scope of application of personal data protection provisions, the rights and duties of the data subject or controller, the processing of special personal data or processing personal data for special purposes, personal data authorities and finally the personal data penal provisions. In the last chapter the thesis deals with some chosen practical problems in Finland.
