Legal Reasons for Non-return of a Child in Case of International Abduction

Abstract:

Diplomová práce představuje esenciální termíny jako mezinárodní únos dítěte, příslušnost, autonomní výklad a obvyklé bydliště, nejen na základě legálních definic, které nejsou vždy dostupné, ale i s ohledem na judikaturu. Udává také právní základ, na němž jsou postaveny mezinárodní dokumenty zabývající se únosy dětí. Druhá kapitola popisuje návratové řízení z pohledu Haagské úmluvy a nařízení Brusel II bis. Třetí kapitola analyzuje a shrnuje důvody nenavrácení dítěte při mezinárodním únosu, jak jsou specifikovány Haagskou úmluvou, a je do ní zapracována také judikatura, která slouží jako hlavní nástroj pro korektní výklad pojmů užitých Haagskou úmluvou. Diplomová práce se snaží dokázat hypotézu, že přestože mezinárodní únos dle Haagské úmluvy a nařízení Brusel II bis je protiprávním úkonem, existují důvody ospravedlňující nenavrácení dítěte do státu jeho obvyklého bydliště.

Abstract:

The diploma thesis introduces the basic terminology such as international child abduction, jurisdiction, autonomous interpretation and habitual residence, not only with a legal definition which is not always available, but also on the basis of jurisprudence. The legal foundation on which the international documents concerning child abduction are based is given as well. The second chapter describes the procedure of return of the child from the point of view of the Hague Convention and Brussels II bis regulation. The third chapter analyses and summarises the reasons for non-return of the child in case of international abduction as specified by the Hague Convention and this chapter is completed with the jurisprudence which is the main instrument for proper interpretation of the concepts used in the Hague Convention. The diploma thesis is trying to prove the hypothesis that even though the internatinal child abduction as defined by the Hague Convention and Brussels II bis regulation is a wrongful act, there might exist reasons qualifying non-return of the child into the State of his or her habitual residence.
