Role of the Office for International Legal Protection of Children in the issue of international abductions

Abstract:

Diplomová práce se věnuje tématu mezinárodních únosů dětí se zaměřením na Úřad pro mezinárodněprávní ochranu dětí (dále jen jako "Úřad"). Práce je systematicky rozdělena do šesti kapitol. První kapitola představuje obecný úvod do problematiky mezinárodních únosů. Druhá kapitola přináší přehled nejdůležitějších pramenů právní úpravy v dané oblasti. Pozornost je věnována relevantní právní úpravě mezinárodní, právní úpravě v rámci Evropské unie a rovněž vnitrostátní právní úpravě. Třetí kapitola práce je zaměřena na pojmosloví vztahující se ke sledované oblasti. Kromě definice pojmu "mezinárodní únos dítěte" kapitola přináší osvětlení i dalších klíčových termínů z předmětné oblasti. Čtvrtá kapitola se zabývá stěžejním tématem diplomové práce, kterým je Úřad pro mezinárodněprávní ochranu dětí. V úvodu kapitola stručně nastiňuje historický vývoj Úřadu, jeho organizační strukturu a obecnou charakteristiku agendy, jíž se Úřad zabývá. Následně se kapitola podrobně věnuje konkrétním úkolům a postupům Úřadu v případech mezinárodních únosů dětí, v nichž vystupuje buď v roli dožadujícího, nebo dožádaného ústředního orgánu. Závěr čtvrté kapitoly je zaměřen na preventivní činnost Úřadu v oblasti mezinárodních únosů. Pátá kapitola pak teoretická východiska vyjádřená v kapitole předchozí demonstruje prostřednictvím několika případů mezinárodních únosů dětí z praxe Úřadu. Závěrečná šestá kapitola pojednává o smírném řešení rodičovských konfliktů prostřednictvím metody mediace, jíž Úřad ve věcech týkajících se nezletilých dětí rovněž nabízí.

Abstract:

The diploma thesis dedicated to international child abductions aimed at The Office for International Legal Protection of Children (hereinafter referred to as "The Office"). The diploma thesis is systematically divided into six chapters. The first chapter is conceived as a general introduction to the issue of international child abductions. The second chapter provides an overview of the most important sources of legal regulation in the issue in question. Attention is paid to relevant international legislation, legislation within the European Union as well as national legislation. The third chapter is focused on terminology related to the issue in question. In addition to the definition of "international child abduction", the chapter provides an explanation of other key terms in the objective issue. The fourth chapter deals with the main topic of the diploma thesis that is The Office for International Legal Protection of Children. The introduction briefly outlines the historical development of The Office, its administrative structure and the general characteristics of the agenda in which The Office carries out its activities. Subsequently, the chapter deals in detail with the particular tasks and procedures of The Office in cases of international child abductions in which it acts either as a requesting Central Authority, or requested Central Authority. The fourth chapter is focused on the preventive work of The Office in the issue of international child abductions, too. The fifth chapter demonstrates the theoretical backgrounds outlined in the previous chapter through several cases of international child abductions from the practice of The Office. Finally, the sixth chapter deals with the amicable settlement of disputes between parents through mediation which The Office also offers in matters concerning minors.
