The position of the child within the adoption

Abstract:

Diplomová práce s názvem Postavení dítěte v rámci osvojení se skládá ze dvou částí, a to z části teoretické a výzkumné. Diplomová práce se věnuje postavení dítěte v rámci osvojení. Cílem mé diplomové práce je popsat a analyzovat postavení dítěte v rámci osvojení se zdůrazněním postavení dítěte v kontextu jeho práv. Teoretická část je rozdělená do čtyř kapitol. V úvodní kapitole vymezuji pojem osvojení a věnuji se historickému vývoji osvojení s ohledem na práva dětí a s ohledem na postavení dítěte. Dále zde pojednávám o současné legislativní úpravě osvojení. Následující kapitola se zabývá analýzou institutu osvojení a zprostředkováním osvojení. Stěžejní kapitolou mé práce je kapitola třetí, v níž se věnuji postavení dítěte v rámci osvojení z hlediska jeho práv. Teoretickou část uzavírám kapitolou čtvrtou, ve které přibližuji proces zprostředkování osvojení v kontextu postavení dítěte a kde rovněž popisuji roli sociálního pracovníka v rámci osvojení. Výzkumná část je obsažena v páté kapitole a je zpracována kvalitativní výzkumnou strategií ? metodou případové studie a jako techniku sběru dat jsem zvolila polostrukturovaný rozhovor a analýzu dokumentů.

Abstract:

The diploma thesis consists of two parts, the theoretical part and the research part. The diploma thesis deals with the position of the child within the adoption. The aim of my diploma thesis is to describe and analyze the position of child in adoption with emphasis on the position of the child in the context of his rights. Theoretical part is divided into four chapters. In the introductory chapter, I defined the whole concept of adoption and deals with the historical development of adoption with regard to children´s rights and with regard to the position of the child. Furthermore, here I discuss the current legislation of adoption. The following chapter deals with the analysis of the institute of adoption and the mediation of adoption. The main chapter of my thesis is the third chapter, in which I deal with the position of the child in the context of adoption in terms of his rights. I conclude the theoretical part with the fourth chapter, in which I describe the process of mediation of the adoption in the context of the position of the child and where I also describe the role of a social worker in the adoption process. The research part is contained in the fifth chapter and its elaborated using by qualitative research strategy of case study method, and as a technique of data collection I chose a semi-structured interview and document analysis.
