Abstract:

Tato diplomová práce se zabývá vývojem institutu spolupracujícího obviněného, který je zakotven v našem trestním právu a to v § 178a trestního řádu. V první části práce popisuji organizovaný zločin a jeho historii, která dala institutu spolupracujícího obviněného potřebu vzniknout a dále právní úpravu, která má za cíl organizovaný zločin postihovat. V další části je popisován vznik a vývoj institutu korunního svědka v zahraničí a úvahy o jeho zařazení do právního řádu České republiky. Institut korunního svědka jako takový měl být zaveden i do českého právního řádu, avšak z nedostatku pozitivních odborných názorů a neprůchodnosti zákona parlamentem, nebyl nikdy přijat. Závěrečná část práce je zaměřena na institut spolupracujícího obviněného z pohledu jeho vzniku, užití a úvah de lege ferenda. V neposlední řadě je popsáno využití tohoto institutu v kauze Davida Ratha a spolupracující obviněné Ivany Salačové v případové studii, ve které je tato kauza rozebrána.

Abstract:

This diploma thesis deals with the development of the institute of a cooperating accused, which is enshrined in our criminal law in § 178a of Criminal Procedure Code. In the first part of the thesis, I describe organized crime and its history, which allow the institute of a cooperating accused to arise, as well as legislation that aims to punish organized crime. In the next part, the origin and development of the institute of a crown witness abroad are described, including considerations about its inclusion in the legal order of the Czech Republic. The Crown Witness Institute as such was to be introduced into the Czech legal system, but due to the lack of positive expert opinions and the impenetrability of the law by the parliament, it was never adopted. The final part of the thesis is focused on the institute of a cooperating accused in terms of its origin, use, and considerations de lege ferenda. Last but not least, the use of this institute is described in the analyzed case study, more precisely in the case of David Rath and the cooperating accused Ivana Salačová.
