Employment law in EU

Abstract:

Pracovní právo Evropské unie se začalo vyvíjet se vznikem Evropského sdružení uhlí a oceli a Evropského hospodářského společenství. Dnes toto právo je dost složitým meziodvětvovým komplexem principů a norem, které jsou obsaženy v primárních a sekundárních právních aktech Evropské unie(a také v jiných zdrojích práva EU) regulujících vztahy mezi fyzickými osobami (zaměstnanci a jinými), firmami a úřady, Evropskou unií (včetně jejích institucí a orgánů) v oblasti práce. Tato práce obsahuje kratký popis základních fází historického vývoje pracovního práva EU a jeho struktury, rozbor základních bodů, které se týkají svobody pohybu zaměstnanců, doržování lidských práv v pracovněprávních vztazích, práv zaměstnanců a organicace práce. Určitá pozornost se také věnuje rozvoji Evropského sociálního dialogu a společenské odpovědnosti firem v kontextu pracovního práva Evropské unie, což je názorným příkladem zesílení jeho sociálního zaměření.

Abstract:

Labor Law of the European Union has developed over a long period of time starting from the points when the European Coal and Steel Community and later the European Economic Community were established. Nowadays it has become a rather complex intersectoral set of principles and standards embodied in the EU founding treaties and secondary legislation (as well as other EU law instruments) governing relations with individuals (employees and other categories), organizations and companies, the Union itself (including its institutions and other bodies) and its Member States in the field of labor. The results of this paper include a brief review of the basic steps in the development of European Union Labour Law, the identification of its internal structure, and overview of its main provisions relating to freedom of movement for workers, Human Rights in the sphere of employment, employment rights and work organization standards. In order to illustrate the tendency of social orientation of European Union Labour Law certain attention is paid to the development of such EU social policy issues of direct relevance to the area of employment as the European Social Dialogue and the Corporate Social Responsibility.
