Customs administration and its activities in criminal proceedings.

Abstract:

Pojem trestního řízení není novým pojmem ačkoli od svých počátků udělalo velký pokrok. Mnoho lidí ovšem neví, jak tento pojem uchopit, přestože ho znají ať už z knih nebo médií. Oproti tomu Celní správa České republiky jako pověřený policejní orgán činný v trestním řízení je pojem, který ne každému může být znám a jasný. Cílem této diplomové práce je objasnit pojem Celní správa, trestní řízení, činnost Celní správy v trestním řízení, a především komparace činnosti Celní správy České republiky s činností Policie České republiky. Pro lepší komparaci činnosti Celní správy České republiky a Policie České republiky, byly přidány do diplomové práce polostrukturované rozhovory s příslušníky Celní správy České republiky, kteří vykonávali službu v oblasti trestního řízení také u Policie České republiky. Za použití metody komparace a polostrukturovaného rozhovoru, bylo zjištěno, že velký rozdíl v činnosti těchto dvou bezpečnostních sborů není, největší rozdíl, lze shledat v kompetencích, které byly policejním orgánům přiděleny.

Abstract:

The concept of criminal procedure is not a new concept although it has made great progress since its beginning. However, many people do not know how to handle the concept, even though they are familiar with it either from books or the media. On the other hand, the Customs Administration of the Czech Republic, as the designated police authority in charge of criminal proceedings, is a concept that may not be familiar and clear to everyone. The aim of this thesis is to explain the concept of Customs Administration, criminal proceedings, the activities of the Customs Administration in criminal proceedings, and above all to compare the activities of the Customs Administration of the Czech Republic with the activities of the Police of the Czech Republic. In order to better compare the activities of the Customs Administration of the Czech Republic and the Police of the Czech Republic, semi-structured interviews with officers of the Customs Administration of the Czech Republic, who have also served in criminal proceedings with the Police of the Czech Republic, have been added to the thesis. Using the method of comparison and semi-structured interviews, it was found that there is no big difference in the activities of these two security forces, the biggest difference can be found in the competences assigned to the police authorities.
