Preliminary precautions as an instrument of solution of the crisis situation in social-legal protection of children

Abstract:

Diplomová práce se zabývá předběžným opatřením, které je užíváno jako nástroj řešení krizových situací v sociálně-právní ochraně dětí. Cílem práce bylo zmapování krizových situací, ve kterých je předběžné opatření jediným možným řešením. Výzkumná část je zaměřena na vnímání tohoto institutu sociálními pracovníky orgánu sociálně-právní ochrany dětí. Práce se skládá z teoretické a výzkumné části. V teoretické části se věnuji právním předpisům souvisejícím s problematikou sociálně-právní ochrany dětí a ukotvení institutu předběžného opatření v právním řádu České republiky. Předběžné opatření podle ustanovení § 76a občanského soudního řádu je podrobně charakterizováno a jsou uvedeny důvody, které k tomuto opatření vedou. Věnuji se též činnosti sociálního pracovníka a způsobu posuzování rodin. Výzkumná část předkládá zjištěné výsledky k postoji sociálních pracovníků OSPOD k institutu předběžného opatření a potvrzuje důležitost tohoto institutu.

Abstract:

This thesis deals with the preliminary precaution which is used as an instrument of solution of the crisis situation in social-legal protection of children. The aim was to map crisis situations in which preliminary precaution is the only possible solution. The research section is focused on the perception of this institute of social workers of department of social-legal protection of children. The thesis consists of theoretical and research section. The theoretical part deals with legislativ related to issues of social-legal protection of children and anchoring of preliminary measures in the legislativ of the Czech Republic. The preliminary precaution pursuant to § 76a of the Civil Procedure Code is characterized in detail and the reasons that have led to this action. I deal with to the activities of a social worker and the manner of assessing families. The research section presents the results obtained with the position of social workers of social-legal protection of children to institute preliminary precaution and confirms the importace of this institute.
