Criminal Electronic Filing

Abstract:

Cílem bakalářské práce bylo především seznámit se s problematikou využívání elektronického trestního spisu jednotlivými orgány činnými v trestním řízení v trestním řízení. Úvod bakalářské práce byl věnován trestnímu právu, jeho rozdělení a účelu. V úvodu práce jsem se dále věnoval trestnímu řízení, kdy kromě jeho účelu jsem se podrobně zaměřil na jednotlivé zásady trestního řízení. Poté jsem se zmínil o jednotlivých orgánech činných v trestním řízení, mezi něž se řadí zejména policejní orgán, státní zástupce a soud. Dále bylo pojednáno o jednotlivých stadiích trestního řízení. V další části bakalářské práce jsem se podrobněji věnoval problematice informačního systému „Evidence trestního řízení“, jež je v současné době hojně využíván Policií České republiky při procesu elektronizace dokumentů a vytváření elektronických spisů. Poté jsem se zmínil jak o spisové službě v obecném měřítku, tak i o spisovém řádu Policie České republiky. Závěr práce byl věnován problematice trestního spisu, kde jsem se věnoval především jeho tvorbě, řazení, prostudování, konverzi a uzavření. V závěru práce bylo poté pojednáno rovněž o problematice elektronického trestního spisu.

Abstract:

The objective of this bachelor thesis was to define the concept of criminal procedure and further to introduce the issue of electronic criminal file. The introduction of my thesis was devoted to criminal law in general, its classification and purpose. I also dealt with criminal procedure; besides its objectives I focused in detail on particular principles of the procedure. After that I mentioned the particular authorities operating in criminal procedure, among which the police authority, public prosecutor and court belong. The stages of criminal procedure were addressed as well. In the next section of the thesis I dealt in a greater detail with the issue of the information system „Criminal procedure records“, which is nowadays being used frequently by the Police of the Czech Republic for document electronization and creation of electronic files. I further mentioned both the filing service in general and the filing scheme of the Police of the Czech Republic in particular. The conclusion of the thesis was concerned with criminal file and in particular I focused on the issue of its ordering, examination and closure. In the end of the thesis the electronic criminal file was addressed as well.
