Czech Customs Administration, the Body Active in Criminal Proceedings

Abstract:

Účelem a cílem této práce bylo shrnout, popsat a vysvětlit,kdo je to policejní orgán, v tomto případě pověřený celní orgán Celní správy ČR a tím změnit společenské vnímání,jak na Celní správu ČR, tak na pověřený celní orgán a vysvětlit i další věcí vztahujících se k trestnímu řízení. V úvodní části jsem se snažil shrnout a popsat, co je to trestní řízení, jaká jsou základní stádia trestního řízení a průběh trestního řízení (viz. Příloha č. 2). Také jsem se zde snažil shromáždit výčet všech subjektů podílejících se trestním řízení podle platných právních norem v ČR. V další části jsem se snažil popsat kdo je policejní orgán, který je zmiňován v ustanovení § 12 odst. 1 trestního řádu. Vysvětlit, jaká má policejní orgán oprávnění v trestním řízení a rozlišit jeho místní a věcnou příslušnost. Dále popsat odlišnosti ve struktuře policejních orgánů před zahájením trestního stíhání a po jeho zahájení. Chronologii hlavních legislativních změn v § 12 odst. 2 trestního řádu, které mají vliv na pravomoci policejních orgánů jsem popsal současně v Příloze č. 1. V předposlední části jsem se pokusil přiblížit Celní správu ČR jako celek tím, že jsem se ji snažil nejprve obecně popsat a následně popsat její působnost i s hlavními úkoly a pravomocemi (viz. Přílohy 3 – 6). V poslední části jsem se snažil popsat kdo je pověřený celní orgán. Shrnul jsem zde jeho oprávnění a působnost. Dále jsem se pokusil vyjmenovat všechny trestné činy, ke kterým je věcně příslušný pověřený celní orgán a současně u každého konkrétního trestného činu je vysvětleno, kdo je subjektem trestného činu, co je to subjektivní stránka trestného činu, kdo je objektem trestného činu a co je to objektivní stránka trestného činu (viz. Příloha č. 7). Ke každému trestnému činu, ke kterému je věcně příslušný pověřený celní orgán jsem přiřadil i paragrafové označení trestného činu v novém trestním zákonu č. 40/2009 Sb. trestní zákoník, v platném znění, který je již sice v současnosti platný, ale má posunutou účinnost od 1. 1. 2010, kdy nahradí stávající Trestní zákon č. 140/1961 Sb. Dále jsem se snažil popsat i vzájemnou vnitrostátní a mezinárodní pomoc v oblasti trestního řízení a z oblasti mezinárodní spolupráce vypsat a následně popsat ty nejznámější mezinárodní projekty EU v boji proti trestné činnosti, jako je OLAF, EUROPOL, EUROJUST a Evropská justiční síť.

Abstract:

The purpose and objective of this study was to resume, describe and explain what the police body is; particularly in this case as an entrusted customs administration body of the Czech Republic. Thereby to change a public perception of Customs administration of the Czech Republic and the entrusted customs administration body and further explain also other things related to criminal procedure. The purpose and objective of this study was, as mentioned in the introduction, to resume and describe what the police body is; particularly in this case as an entrusted customs administration body of the Czech Republic. Thereby to change a public perception of Customs administration ČR and the entrusted customs administration body and further explain also other things related to criminal procedure. I hope I managed to give the reader a closer view on criminal procedures processes, as well as on police bodies work, mainly those customs administration bodies, and clear relations among subjects which are present in different criminal procedure phases. In the introduction part, I tried to resume and describe what the criminal procedure is in general, what are the essential phases of this procedure and also the process of the criminal procedure itself (see Appendix no.2). I also tried to gather list of subjects participating on the criminal procedure according to Czech valid legal rules. The next part describes who is the police body mentioned in the regulation § 12 article 1 of code of criminal procedure. I explained which competences are given to the police body during the criminal procedure and differentiate its territorial and material pertinence. I described differences in the police bodies structure before prosecution initiation and afterwards. Main legislation changes chronology in § 12 article 2 of the code of criminal procedure which influence authority of the police bodies are described also in Appendix no.1. The part before last one contains description of Customs administration of the Czech Republic as a complex unit. First of all, there is a general description of CA ČR, then its field of action together with the main objectives and authorities (see Appendix no. 3-6). In the final part, the CA ČR is described as the entrusted custom administration body. I resumed there its competence and the field of action. I tried to specify all criminal acts to which have the entrusted customs administration body material pertinence. Each criminal act has detailed specification regarding the criminal act subject, what is it the subjective side of the criminal act, who is the criminal act object and finally, what is the objective side of the criminal act (see Appendix no. 7). I added a criminal act paragraph notation of the new Penal code no. 40/2009 Col. Criminal code, to each described criminal act to which has the entrusted customs administration body material pertinence. Mentioned Penal code is presently valid but has a postponed effectivity as of 1.1.2010 when it will replace the present Penal code no. 140/1961 Col. The final part also contains description of the mutual intrastate and international help in terms of criminal procedure. From the field of the international cooperation, I listed and subsequently described the most known fighting the criminal activity international EU projects, as are OLAF, EUROPOL, EUROJUST and European justice net.
