The criminality of the youth

Abstract:

Tématem této bakalářské práce je problematika jednoho z nejzávažnějších společenských problémů, a to kriminalita mládeže a její řešení v trestně právní rovině. V první teoretické části práce jsou popsány jak právní předpisy, které je nutno při řešení kriminality mládeže dodržovat, aby byla zachována veškerá práva mladistvého pachatele, tak podmínky pro trestní odpovědnost mladistvého a základní zásady trestního řízení vedeného proti mladistvému pachateli. Je zde také popsáno postavení jednotlivých subjektů jednajících ve prospěch mladistvého a také orgánů činných v trestním řízení. Teoretická část se dále zaměřuje na jednotlivá specifika a odlišnosti v trestním řízení proti mladistvému pachateli a zároveň jsou tato specifika porovnána s trestním řízením proti pachateli dospělému. Druhá část práce je naopak zaměřena na skutečné případy trestných činů, kterých se dopustili mladiství pachatelé, je popsán průběh trestního řízení od zahájení úkonů v trestním řízení až po vynesení rozsudku soudního senátu. Postup trestního řízení u těchto případů je vyhodnocen a porovnán s příslušnými právními předpisy, zda byla práva mladistvého dodržena. V závěru je pak toto vyhodnocení a porovnání s právními předpisy shrnuto. Vyplynulo tak, že přesto, že trestní řízení proti mladistvým pachatelům je vedeno vyškolenými specialisty, zejména v přípravném řízení vedené policejním orgánem, objevují se v řízení procesní chyby, které lze však napravit tak, aby byla veškerá práva mladistvého zachována.

Abstract:

The theme of this bachelor thesis is of one the most serious social problems, the criminality of youth and dealing with this problem at the level of criminal law. The first, theoretical, part of this thesis describes the legislation which is necessary to be adhered when dealing with youth criminality in order to respect the rights of juvenile offenders. It also describes the circumstances for juvenile crime responsibility and the basic principles of criminal proceeding against a juvenile offender. This part also describes the status of individual entities acting in favour of the juvenile and also the people involved in the criminal proceeding. The theoretical part focuses on specifics and differences in criminal proceedings against a juvenile offender. These specifics are compared with the criminal proceedings against an adult offender as well. The second part of this thesis is focused on real criminal cases committed by juvenile offenders and describes the process of criminal proceeding from the beginning to the final judgement of the court. The process of criminal proceeding of these cases are evaluated and compared with relevant legislation to see if the rights of the juveniles were respected. The final part evaluates and compares the results with the legislation summarizes. The result is that while the criminal proceeding against juvenile offender is conducted by trained specialist, especially at the first part of criminal proceeding, which is conducted by the police authority, procedural mistakes appear in the proceeding. However, these mistakes can be rectified so that all rights of the juvenile are respected.
