RESTRICTION AND DEPRIVATION OF LEGAL CAPACITY

Abstract:

Tato diplomová práce s názvem omezování a zbavování způsobilosti k právním úkonům je tematicky členěna do pěti tematických kapitol obsahujících vymezení některých základních pojmů, pojednání o mezinárodních dokumentech a o soudní ochraně nesvéprávných. Svým obsahem se především zabývá zkoumáním a rozborem současné právní úpravy upravující omezování a zbavování způsobilosti k právním úkonům, zabývá se výkladem nejdůležitějších mezinárodních dokumentů a v návaznosti na tento výklad pak rozborem právního postavení duševně postižených a nesvéprávných osob. Vedle kritiky procesu omezování a zbavování způsobilosti k právním úkonům vyjevuje a analyzuje vážné nedostatky systému opatrovnictví. Pomocí odkazů na velké množství právních předpisů ilustruje roztříštěnost právní úpravy a věnuje velkou pozornost chybějícím zákonným ustanovením, která by proces omezování a zbavování způsobilosti k právním úkonům zdokonalila a dnešní situaci v systému opatrovnictví změnila k lepšímu.

Abstract:

This diploma thesis entitled Restriction and Deprivation of Legal Capacity is thematically divided into five thematic chapters containing the definition of some basic terms, a treatise on international instruments and on judicial protection of persons deprived of civil rights. Its content mainly deals with the exploration and analysis of current legislation governing restriction and deprivation of legal capacity, it deals with the interpretation of the most important international documents and in connection with this interpretation it provides the analysis of the legal status of mentally handicapped people and persons deprived of civil rights. Besides the criticism of the process of restriction and deprivation of the legal capacity, it reveals and analyzes the serious deficiencies in the system of guardianship. Using the links to the large amount of legal regulations, it illustrates the fragmentation of legislation and pays great attention to the lack of legal provisions which would improve the process of restriction and deprivation of legal capacity and which would change the current situation in the guardianship system for the better.
