Abstract:

Protektorát Čechy a Morava existoval pouhých 6 let, od roku 1939 do roku 1945. Cílem práce je poskytnutí pohledu na právní povahu protektorátu, státoprávní a politické aspekty, konkurenci obou linií správy v protektorátu a vyrovnání se s následky okupace. Práce obsahuje úpravu vzniku protektorátu, otázku zda dané státní zřízení bylo vlastně státem, organizaci veřejné moci, postavení autonomních orgánů, reformu veřejné správy do nástupu Heydricha, správní reformy prováděné v letech 1942 – 1943. Je zde upravena konkurence německého a protektorátního práva v oblasti trestního a občanského práva. Práce je zakončena nástinem zániku protektorátu a následným vyrovnáním se s následky nacistické okupace, s čímž jsou spjaty i dodnes diskutované dekrety prezidenta Beneše.

Abstract:

The Protectorate of Bohemia and Moravia existence endured mere 6 years, from 1939 to 1945. The goal of this work being to educe evidence of protectorate´s legal format, its constitutional and political aspects, about the competition of both types of administration in the protectorate, and finally to deal with the occupation consequences. The work contains information on protectorate´s creation, the question of whether the establishment was in fact a state, the organization of the public authority, the status of the autonomous protectorate´s bodies, the revision of the public administration until the Reinhard Heydrich´s entry, and revisions of the public administration in 1942-1943. Also, the work includes the competition issues of the criminal law and civil law between German and protectorate laws. The whole work is concluded with the summary of protectorate´s downfall and subsequent facing up to Nazi occupation consequences, which has been connected to the until present days discussed issue of Benes presidential decrees.
