Limits to the right to information in connection with the compensation of costs

Abstract:

Právo na informace je základním lidským právem, které je upraveno v právním prostředí, jak na úrovni mezinárodní, tak na úrovni národní. Toto právo je význačné zejména v kontextu možnosti kontrolovat veřejný sektor. Každé právo má však své limity, jelikož z povahy věci zasahuje do práv jiných subjektů, aneb tam kde jedno právo končí, začíná druhé. Právo na informace má tedy také své limity. Jedním z limitů vzniká ze samotných kapacit veřejného sektoru. Pro poskytnutí dané informace musí být vynaložené určité zdroje v podobě práce a materiálu. Kapacity veřejného sektory však nejsou bezbřehé. Právní úprava práva na informace s tímto limitem práva na informace počítá. Kam však až tyto limity sahají? Právě na tuto problematiku je diplomová práce zaměřená. Diplomová práce shrnuje právní úpravu práva na informace v prostředí České republiky a analyzuje limity z hlediska úhradu nákladů na poskytnutí informace, včetně praktických příkladů. Diplomová práce bude rovněž obsahovat úvahy autora de lege ferenda.

Abstract:

The right to information is the fundamental human law, which is regulated in the legal environment, both at the international and national level. This right is particularly prominent in the context of the possibility to control the public sector. However, every right has its limits, as it, by nature, interferes with the rights of other entities, or where one right ends, the other begins. Therefore, it also has its limits. One of the limits arises from the public sector capacities themselves. Certain resources in the form of work and material must be spent to provide the information. However, public sectors are not boundless. The legislation of the right to information with this limit to the right to information counts. But where do these limits go? This thesis is focused on this issue. The diploma thesis summarizes the legislation of the right to information in the environment of the Czech Republic and analyzes limits in terms of reimbursement of the costs of providing information, including practical examples. The diploma thesis will also include the considerations of the author de lege ferenda.
