EU Accession to the Convention for the Protection of Human Rights and Fundamental Freedoms from the Perspective of integration paradigms

Abstract:

Tato bakalářská práce se zabývá otázkou přistoupení EU k Úmluvě o ochraně lidských práv a svobod. Mapuje vývoj vztahu EU a Rady Evropy, pozici lidských práv v těchto organizacích a historii myšlenky přistoupení. Mezi základní argumenty debaty patří posílení ochrany lidských práv, zabránění existence konkurenčních systému ochrany, zajištění jednotného vystupování EU v řízení u ESD, možné ohrožení autonomie komunitárního práva. Celá problematika je v práci nahlížena z pohledu integračních paradigmat, což se projevuje i ve stanovení hypotézy: Supranacionalisté a intergovermentalisté mohou podporovat přistoupení EU k Úmluvě na základě odlišných důvodů. Hypotéza je ověřována na základě postojů členských států, které jsou rozděleny na dvě skupiny dle preferované metody integrace.

Abstract:

This bachelor thesis deals with the EU Accession to the Convention for the Protection of Human Rights and Fundamental Freedoms. It covers development of relationship between EU and Council of Europe, status of human rights in those organizations and history of accession idea. To the main arguments in debate belong strengthening of the human rights protection, avoiding existence of competing systems of protection, ensuring coherent EU appearance in proceedings before European Court of Justice, possible threat to Community legal order autonomy. Whole issue is in thesis viewed from the integration paradigms perspective and that is expressed in the hypothesis concept: Supranacionalists and intergovernmentalists may support the EU accession to the Convention for the Protection of Human Rights and Fundamental Freedoms on the basis of different reasons. Hypothesis is verified on member states positions, which are divided into two groups according to the preferred Method of integration.
