Abstract:

Tato bakalářská práce je zaměřena na daň z přidané hodnoty u služeb, přesněji zaměřena na zvláštnosti zdaňování služeb ve stavebnictví se zvláštní pozorností na režim přenesení daňové povinnosti. V první části práce je nejprve popsána zákonná úprava daně z přidané hodnoty a režimu přenesení daňové povinnosti „revers charge“ obecně. Stěžejní část práce je věnována tuzemskému režimu u poskytování stavebních prací. Tato část práce obsahuje především přehled podmínek upravujících používání režimu přenesení daňové povinnosti u poskytovatele a u příjemce služeb, dále náležitosti daňových dokladů a výpisu z evidence pro daňové účely, přiznání k DPH. V práci jsou uvedeny i další aspekty režimu přenesení daňové povinnosti včetně přechodných ustanovení upravující přechod z původního režimu zdaňování. Druhá část práce je zaměřena především na historický vývoj sazeb daně ve stavebnictví, právní úpravu sazeb a sazby daní u bytové výstavby a staveb pro sociální bydlení. V praktické části nalezneme příklad daňových dokladů poskytovatele i příjemce plnění v režimu přenesení daňové povinnosti, výpisem z evidence pro DPH a ukázkou daňového přiznání s vyznačením operací v režimu a nakonec kontrolní opisy výpisů z evidence pro daňové účely.

Abstract:

This bachelor thesis is focused on value-added tax on services, specifically focused on the peculiarities of taxation construction services with special attention to the reverse charge procedure. In the first part of the thesis describes the statutory regulation of value added tax and the reverse charge in general. The main part is devoted to the domestic arrangements for the provision of construction work. This section contains an overview of particular conditions governing the application of the reverse charge to the provider and recipient of services, terms of tax documents and extract records for tax purposes, VAT returns. The thesis also describes other aspects of the reverse charge procedure including the temporary regulations governing the transition from the former way of taxation. The second part is focused on the historical evolution of tax rates in construction, regulation of rates and tax rates for residential construction and social housing. The practical part shows an example of tax documents of the reverse charge procedure of the provider and recipient: an extract from the register for VAT and income tax return demonstration showing the operation mode and finally control copies of extracts from the records for tax purposes.
