Abstract:

Diplomová práce je tematicky zaměřena na oblast způsobilosti k právním úkonům osob se postižením a s tím související dílčí problematikou institutu opatrovnictví. Součástí zmíněné oblasti je též problematika samovolného odchodu postiženého ze zařízení, která nejsou k péči o osoby s postižením dostatečně přizpůsobeny. Omezení či odebrání způsobilosti k právním úkonům osobám s postižením je významným zásahem do lidských práv těchto jedinců a tudíž je na místě k těmto krokům přistupovat maximálně citlivě a zodpovědně. Současný stav dané problematiky u nás je výrazně rigidní a neumožňuje využívání alternativních řešení, jež se osvědčují v některých jiných státech. Práce popisuje základní pojmy a jednotlivá dílčí témata související se zmíněnou problematikou a snaží se charakterizovat alternativní způsoby řešení daných situací a případů. Důsledně analyzuje jednotlivé problematické oblasti, která se k tématu váží, přičemž na tyto oblasti implementuje alternativní možnosti, jež jsou praktikovány na poli mezinárodním a které český právní řád neumožňuje.

Abstract:

The thesis is thematically focused on legal capacity of persons with disabilities and on a related issue of the institute of guardianship. One part of this area includes solving problems with the disabled people’s spontaneous leaving the sanitary facilities which are not adapted enough to provide care for the disabled. The institute of reduction or removal of the legal capacity of persons with disabilities is a significant intervention in the fundamental human rights of those persons and therefore it is necessary to act most sensitively and responsibly. The current situation of this issue in our country is strongly rigid and it does not allow the use of alternative solutions, which have been approved in some countries. This thesis provides and describes basic terminology and particular sub-themes, which are related to this topic. It also tries to characterize the alternative solutions for the mentioned situations and cases. It consistently analyzes particular problem issues, which are connected with this topic and at the same time it implements alternative ways on the issues, which are internationally practiced but which are not allowed by the Czech law.
