Legal aspects of the personal data protection in the public health

Abstract:

Předložená diplomová práce se zabývá ochranou osobních údajů v oblasti zdravotnictví. Po obecném přiblížení historického vývoje a současného stavu ochrany osobních údajů v legislativní rovině (vývoj specializované legislativy na národní i nadnárodní úrovni) následuje nastínění konkrétní situace v oblasti zdravotnictví. Konkrétně jde zejména o to jaké osobní údaje zdravotnická zařízení zpracovávají, jakým způsobem je uchovávají a jakým způsobem brání jejich zneužití. Povědomí pacientů o ochraně jejich osobních údajů je zde prezentováno formou dotazníkového šetření uskutečněného metodou řízeného rozhovoru.

Abstract:

The submitted thesis deals with the protection of personal data in the area of health care. The first part of this thesis describes the historical development of this issue and the present situation in the field of legislation (a development of specialized legislation on national and transnational level). The following part of the thesis outlines the concrete conditions in the area of health care. Particularly concerns the issue how are the personal data processed by the health institutions and facilities, how are they stored and how are they protected against the misuse. Information about the patients awareness of the protection of their personal data was obtained through the questionnaire investigation by means of methodology of the conducted interviews
