Legal aspects of consumer protection in the food supplements area

Abstract:

Tématem této diplomové práce je současná právní úprava v oblasti ochrany spotřebitele v české a evropské legislativě. Bude hodnocena její obsáhlost, principy a také přístup k řešení vzniklých sporů ze strany soudů a správních orgánů. Nutnost zabývat se ochranou spotřebitele narůstá zejména díky stále větší významnosti mezinárodního obchodu. Každý člověk má dnes neomezené možnosti cestovat do zahraničí a nakupovat tam různé druhy zboží, nebo si je dokonce objednávat přes internet. To je obrovská výhoda moderní doby. Svoboda volného pohybu osob a zboží s sebou ale nese určité otázky a potíže, které je nutné řešit na mezinárodní úrovni. A jde o potíže o to významnější, pokud se jedná o volně dostupné potraviny a doplňky stravy. Předpokladem pro funkčnost tohoto systému je sladění jednotlivých národních právních předpisů s evropskou legislativou. Je ale také funkční i v praxi? Právě tím se bude diplomová práce zabývat.

Abstract:

The topic of this diploma thesis are current legal aspects of consumer protection in the food supplements area in the Czech and European legislation. Scope, principles and approach to settlement of disputes arising from courts and administrative bodies will be assessed. The need to pay attention to consumer protection is rising mainly due to the increasing importance of international trade. Everyone has unlimited possibilities to travel abroad and buy various kinds of goods there or even order them by the Internet. This is a huge advantage of modern times. However, the free movement of persons and goods entails certain issues and difficulties that need to be solved at international level. And this issue is even bigger when it comes to freely available foods and food supplements. A prerequisite for the functionality of this system is the harmonisation of individual national law with European legislation. But is it also functional in practice? That is the topic of this diploma thesis.
