Right to a Fair Trial in the Civil Proceedings

Abstract:

Předmětem disertační práce je právo na spravedlivý proces v civilním soudním řízení. Disertační práce zkoumá pojem a obsah práva na spravedlivý proces a důsledky jeho porušení. Zabývá vzájemným konfliktem jednotlivých principů tvořících právo na spravedlivý proces. Součástí práce je schéma postupu soudu před nařízením jednání a po nařízení jednání ve formě vývojových diagramů. Schémata zachycují sled efektivních kroků tak, aby řízení mohlo být co nejrychleji ukončeno meritorním rozhodnutím za plného respektování práva na spravedlivý proces.

Abstract:

The subject of the thesis is right to a fair trial in the civil proceedings. The thesis deals with concept definition of the right to a fair trial and with results of the breach of this right. Interesting part of the thesis is conflict of the principles (particular aspects of the right to a fair trial). It was created the schema of the particular steps of the court before the hearing takes place and schema of the particular steps of the court in the hearing. Both schemas are in the form of flow-process diagrams. In schemas there is reflected the sequence of the effective steps of the court to finish the trial as fast as possible by judgment with a full respect to the right to a fair trial.
