Mobiliar execution in applicable legislation

Abstract:

Název práce je mobiliární exekuce v platné právní úpravě. Jak z názvu vyplývá, práce se zaměřuje na jeden ze způsobů vymáhání pohledávek v České republice prostřednictvím soudních exekutorů – prodej movitých věcí. Práce se zabývá jednotlivými fázemi exekuce prodejem movitých věcí. Těžištěm práce jsou kapitoly zabývající se zejména soupisem movitých věcí a dražbou. Pozornost je věnována rozboru problematiky věcí, jež nemohou být pojaty do soupisu. Práce se zabývá také možnostmi obrany třetích osob, zejména návrhem na vyškrtnutí věci ze soupisu, vylučovací žalobou a vztahem mezi nimi. Obsaženy jsou taktéž vlastní doporučení a úvahy de lege ferenda. Cílem práce je kriticky rozebrat jednotlivé fáze exekuce prodejem movitých věcí, a také zdůraznit možná úskalí a pochybení, která mohou při exekuci prodejem movitých věcí snadno nastat.

Abstract:

The name of this thesis is mobiliar execution in applicable legislation. As the title shows, this work deals with one of the manners of debt enforcement in the Czech Republic by means of distrainers – selling movable assets. Also deals with the phases of the distraint by selling movable assets. The cores of the thesis are especially chapters applied to an inventory of movable things, and auction of them. Attention is paid to the analysis of the problems of things that cannot be conceived in the inventory of movable things. Thesis also deals with protection of third parties and their rights, in particular the motion to striking out claim from the list action to exempt a claim from the execution of judgment and the connection between them. Personal recommendations and de lege ferenda opinions are also included. The goal of this work is critical analyse the component phases of this type of distraint and also point out possible rigours as well as malpractice likely related to movables execution.
