Personal data protection and exceptions for Police of the Czech Republic

Abstract:

Bakalářská práce podává komplexní přehled o ochraně osobních údajů a o problematice výjimek, které má Policie České republiky při ochraně a zpracování osobních údajů. V první části jsou uvedeny principy ochrany osobních údajů, vysvětleny nejdůležitější pojmy a popsána činnost Úřadu na ochranu osobních údajů. Celá druhá část je věnována zpracování osobních údajů Policií České republiky, představen zákon 273/2008 Sb., o Policii ČR a v závěru je nastíněna problematika zpracování a odebírání biometrických údajů. Ve třetí části práce jsou uvedeny informace, které by neměly chybět v metodologických pokynech a které poukazují na možnosti, které občanům zákon nabízí, pokud mají pocit, že jejich osobní údaje byly zneužity. Současně podává návod, jaké kroky v takovém případě učinit. Poslední část práce přímo na konkrétních případech dokumentuje zneužití osobních údajů ze strany policie, které soud vyhodnotil jako porušení zákona 101/2000 Sb., o ochraně osobních údajů.

Abstract:

The bachelor theses gives comprehensive overview about the personal data protection and about the issue of exceptions for the Police of the Czech republic in the personal data protection and processing. In the first part are presented principles of personal data protection, explained basic concepts and described aktivities of the office for personal data protection. The entire second part is dedicated to processing of personal data by the Police of the Czech republic, introduced the law 273/2008 Coll., on the Police of the Czech republic and in conclusion there is outlined the issue of processing and collection of biometric data. The third part content information, that should not be missed in the methodological guidelines and that point at the possibilities, that the law offers to citizens, if they think, that their personal data were misused. Concurrently gives instructions what steps to take in such a case. The last part of theses directly on concrete cases documented misuse of personal data by police, which the court evaluated as a violation of the law 101/2000 Call., on the Protection of personal data.
