General Inhibitorium

Abstract:

Diplomová práce nesoucí název generální inhibitorium se zabývá aplikací institutu exekučního řízení v praxi se zaměřením na důsledky spojené s přijetím střednědobé novely exekučního řádu. Práce se v prvé řadě stručně věnuje vymezení historie exekučního řízení a dále podrobně legislativnímu procesu při přijetí listopadové novely účinné od 1.11.2009. Poté v práci vymezuji samotný pojem a důsledky, které porušení daného zákazu znamená pro všechny dotčené strany a jakým způsobem jsou tyto následky uplatňovány vůči účastníkům právního vztahu. Rovněž se zabývám rozsahem zákazu, jakož i odklony od generálního inhibitoria a vztahem generálního a speciálního inhibitoria. Dále je věnována pozornost existenci Centrální evidence exekucí a jejímu praktickému využití s ohledem na účel, k němuž byla zřízena. V závěru práce jsou uvedeny návrhy de lege ferenda s návrhem pro řešení některých možných praktických problémů, které by mohly vzniknout.

Abstract:

This diploma thesis with the topic of general inhibitorium deals with application of one of the institutes of the enforcement proceeding in practice with focus on consequences connected with adoption of “medium-term amendment” of Executory Order. At first the thesis attends to limitation of history of enforcement proceeding and than to the legislative process during the adoption of “November amendment” in force from 1.11.2009. After that I define the term general inhibitorium and the consequences, which are connected with application of using this institute in practice and which are important for all involved participants. In the thesis there is mentioned the way how to apply the consequences. I am concerned with the scope of the prohibition as well as the diversions from the prohibition and the relation between general and special inhibitorium. At the last of the thesis the Central evidence of execution is mentioned when especially is dealed with its application in practice with regard to purpose, which it was based on. At the close there are suggested the possibilities of de lege ferenda with proposals for solution of some possible problems in practice, which can come out.
