The status of municipalities in the social and legal protection of children

Abstract:

Tato bakalářská práce se zabývá činností obcí při sociálně-právní ochraně dětí. V teoretické části popisuji, co se rozumí pod pojmem sociálně-právní ochrany dětí, které orgány tuto ochranu poskytují, vysvětluji základní principy, kterými se řídí oblast sociálně-právní ochrany dětí. Rovněž se věnuji otázce, jakým dětem je sociálně-právní ochrana poskytnuta, a v kterých případech. Popisuji úkoly a kompetence orgánů veřejné správy v oblasti sociálně-právní ochrany dětí. Další část se věnuje konkrétním činnostem orgánu sociálně-právní ochrany dětí, jako například sanace rodiny, dětmi týranými, zneužívanými a zanedbávanými, dětmi s výchovnými problémy, postavením a úkoly kurátora pro mládež a v neposlední řadě náhradní rodinné péči. V praktické části jsem formou rozhovoru se soudci civilního, opatrovnického a trestního oddělení Okresního soudu v Ústí nad Labem a se sociálním pracovníkem Orgánu sociálně-právní ochrany dětí Magistrátu města Ústí nad Labem hledala odpovědi na mé otázky. Mým cílem bylo získat praktické poznatky, které by mi umožnily zhodnotit celkovou práci pracovníků sociálně-právní ochrany dětí v Ústí nad Labem, jejich úkoly a kompetence, získat názor na smysl účasti zaměstnanců orgánů sociálně-právní ochrany dětí v řízení před soudem. Zajímalo mne, jaké praktické úkony sociální pracovník, případně kurátor pro mládež, realizuje v současnosti se stáními zastupitelstvími, soudy a jinými správními úřady. Zaměřila jsem se jak na případy protiprávního jednání dětí, tak i na případy, kdy je trestná činnost páchána na dětech.

Abstract:

This bachelor’s thesis discusses the activities taken by municipalities during social and legal protection of children. The theoretical section describes the basic principles governing the sphere of social and legal protection of children. The next section is devoted to the issue of which children social and legal protection is provided to and in which cases. It describes the tasks and competence of public administration bodies in the field of social and legal protection of children. The next section is devoted to the specific actions taken by bodies for the social and legal protection of children, such as family rehabilitation, actions concerning abused children, maltreated and neglected children, children with behavioural problems, the youth curator’s position and tasks and, not least, alternative family care. In the practical section I sought answers to my questions by conducting interviews with judges of the civil, guardianship and criminal departments of the District Court in Ústí nad Labem and with social workers from the Body of social and legal protection of children of the Municipal Authority of Ústí nad Labem. My goal was to obtain practical knowledge, which would enable me to perform a general evaluation of work by workers in the field of social and legal protection of children in Ústí nad Labem, their tasks and competence, and to form an opinion of the purpose of participation by employees of the body for social and legal protection of children during proceedings before a court of law. I was interested in what practical actions a social worker or youth curator takes at present in connection with the public prosecutor’s office, the courts and other administrative bodies. I also focused on cases of illegal activities by children and on cases when crimes are committed against children.
